Hair Loss From Colour Correction Treatment
Case Study - Negligent Hair Stylist Damaged Hair
Ms J had an appointment at a hairdressing salon for a colour correction treatment. Her hair was dyed a dark brown colour, and Ms J was looking for a new dark blonde style. The salon had advised her that this was possible and that they could do it. Following the treatment however, Ms J’s hair ended up a reddish ginger colour, and the salon advised that another correction treatment was needed to try and sort the problem out. When the stylist washed the colour out for the second time, and dried Ms J’s hair, it was obvious that it was in a bad condition, and was excessively dry, brittle and frizzy. When Ms J was brushing her hair at home, clumps began to fall out, and by the following day she had prominent bald patches across her scalp.
Our Legal Advice
Ms J did not return to work for 4 weeks following her hair appointment, due to distress and embarrassment caused by her appearance. During that time she contacted Bartletts, and on our advice, decided to make a personal injury claim against the hair salon. Representing Ms J, we argued that the two treatments she had received were both carried out negligently, as the salon had failed to exercise the reasonable care and skill that one would expect of competent hairdressing professionals. The colour solution had been badly prepared first time around, and to try and correct the mistake, the salon had then over-processed Ms J’s hair, leaving it excessively dried out and causing hair loss. It was relatively clear in this case where responsibility for Ms J’s hair damage lay, and we were able to obtain an admission of liability within a few months. Ms J later received £3,500 in compensation.
